Next, you need to purchase the chosen e-signature certificate and submit an application for its issuance. The next step involves identity verification, for which an identity document will be required. Upon successful verification, you will obtain a qualified electronic signature, which, according to current law, is equivalent to a handwritten signature.

A qualified electronic signature is a special type of electronic signature that meets specific legal requirements to ensure its reliability and integrity. A qualified electronic signature is equivalent to a handwritten signature in terms of legal effects. This means that a document signed with a qualified electronic signature has the same legal validity as a document signed by hand.

To generate a qualified electronic signature, you must have a qualified electronic signature certificate and a qualified electronic signature device.

A qualified electronic signature certificate is an electronic document that contains information about the identity of the certificate owner, their public key and the validity period of the certificate. The certificate is issued by a so-called trust service provider. The supervisory bodies overseeing the work of qualified trust service providers in Poland are the Ministry of Digitalization and the National Certification Center, abbreviated as NCCert.

A qualified electronic signature device is a device that allows to place a signature on a document. The device must meet specific technical requirements, as specified in the Regulation of the Minister of Digitization of 29 August 2021 on qualified electronic signature devices. Most commonly used devices include cryptographic cards and readers or cloud cards accessed remotely.

The procedure for generating a qualified electronic signature is as follows:

  1. Choose a trust service provider and apply for a qualified electronic signature certificate. The application can be submitted online or in person.
  2. Confirm your identity – this is a necessary step in the process of applying for a qualified electronic signature.
  3. After successful identity verification, the trust service provider will issue you a qualified electronic signature certificate.
  4. Upon receiving the qualified electronic signature certificate, install software to manage the qualified electronic signature.
  5. After installing the software, run it.
  6. Select the document you want to sign.
  7. Select the qualified electronic signature certificate you want to use to sign the document.
  8. Click on the “Sign” button.

Once the electronic signature is applied, a message will appear on the document stating that the document has been signed with a qualified electronic signature. This information will include the identity of the certificate owner, as well as the date and time of the signature.
